Terms and Conditions/Payment Policy

Payment Policy

  • Kylie Jane Loy Fitness is licensed to a single user only
  • Your membership or trial starts from the date of purchase
  • All memberships are a recurring fee, so your membership will automatically be renewed on the next payment date (30 days from the previous payment
  • All memberships are a minimum of 3 months and then can be cancelled by the client inside the mindbody app
  • For using a debit/credit card a fee of 1.99% plus .55c per transaction will be extra on top of the membership fee
  • For using an automatic direct debit a fee of .88c per transaction will be an extra on top of the membership fee
  • You pay in advance for what you are to receive. You may cancel at any time, but your membership will remain until what would have been your next payment due date (or your membership expiration date).
  • Memberships can be put on hold at the discretion of KJL Fitness Pty Ltd.
  • Refunds may be given at the discretion of KJL Fitness Pty Ltd.
  • You take full responsibility for your own health and safety when using Kylie Jane Loy, or partaking in anything provided by KJL Fitness on or off Kylie Jane Loy.
  • Contact details will be used to send you emails and gifts and will not be shared with any third parties.

General Terms and Conditions

  • Terms and conditions apply to all information, advice or workouts provided by KJL Fitness Pty Ltd or Kylie Jane Loy, including but not limited to those on social media, blogs, live events, emails and other communication channels.

General Provision

  • KJL Fitness Pty Ltd may change these terms and conditions from time to time by notice to the customer in writing.

Health and Safety

  • You take full responsibility for your own health and safety when using Kylie Jane Loy, or partaking in anything provided by KJL Fitness Pty Ltd on or off Kylie Jane Loy.
  • It is not designed for those with injuries, health problems or any other problems that exercise of any exertion could affect. If you have any contraindications to exercise, then you should seek the help and/or clearance of a GP, physiotherapist or another appropriate health professional.
  • The information provided on Kylie Jane Loy is designed for the general female population, and not for specific people. They are guidelines and tips. Although there is some precise information supplied, these are still guidelines. If you have specific exercise, medical or health questions you should consult your own health professional.
  • If you have any reasons why you should not be restricting your calorie intake, or eating certain foods or food types, or if you have any allergies then you should not consume the food nor follow the food and diet advice specified. You should consult your GP, nutritionist, dietician or other appropriate health professional. The tips and recipes are recommended as a guide only.
  • Kylie Jane Loy is not designed to promote negative body image or extreme training or dieting regimes. They are written based on Kylie’s knowledge from her own experience, research and education. KJL Fitness Pty Ltd  should not be held accountable or liable for the use or interpretation of any of the information provided.

Consumer Guarantees Act 1993

  • Where Kylie Jane Loy Fitness is supplying goods and services to the customer for business purposes within the meaning of the Consumer Guarantees Act 1993, pursuant to section 43, the provisions of that Act will not apply.

Dispute Resolution

No party shall commence any court or arbitration proceedings relating to any dispute or difference arising out of these terms and conditions unless that party has:

  • Given written notice to the other party specifying the nature of the dispute;
  • On receipt of such notice, the parties must use their best endeavours to resolve the dispute expeditiously and in the spirit of co-operation and goodwill within one month of receipt of the notice; and
  • If the parties are unable to resolve the matter themselves, they will participate in mediation with a mutually acceptable third party mediator to resolve the matter within 21 days of appointment of such mediator. 

Governing Law and Jurisdiction

These terms and conditions, including any negotiations, mediation, arbitration, or court proceedings relating to any dispute or difference arising out of them, and any transaction contemplated by it are governed by Australian law. The parties:

  • submit to the jurisdiction of the Australian courts and any court that may hear appeals from these courts;
  • waive any objection to the venue of any legal process on the basis that the process has been brought in an inconvenient forum; and
  • waive any immunity in respect of their obligations under these terms and conditions that they have or acquire from the jurisdiction of any court or any legal process for any reason.
